The U.S. Supreme Court has decided to overturn Roe v. Wade, which guaranteed the Constitutional right to abortion access for nearly 50 years.
The move was not surprising after a leaked draft opinion was published in early May. The highest court ruled 6-3 to overturn the law. The court’s majority opinion was written by Justice Samuel Alito, who penned the leaked draft opinion, as well.
“The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely — the Due Process Clause of the Fourteenth Amendment,” Alito wrote. “That provision has been held to guarantee some rights that are not mentioned in the Constitution, but any such right must be ‘deeply rooted in this Nation’s history and tradition’ and ’implicit in the concept of ordered liberty.”
The lynchpin case stemmed from Dobbs v. Jackson Women’s Health Organization, a case about Mississippi’s law that banned nearly all abortion afters 15 weeks of pregnancy. Many states are expected to implement abortion bans and restrictions as a result of the court’s decision.
